This matter comes before the court on the motion of defendant to dismiss the complaint pursuant to Fed.R.Civ.P. 12(b)(1), 12(b)(2), 12(b)(6) or in the alternative for an order granting summary judgment to the defendant pursuant to Fed.R.Civ.P. 56(b).
