Defendant, Donnie Hawkins, was charged with first degree assault, but convicted of second degree assault, and sentenced to four years' imprisonment as punishment for the crime.

Viewed in the light most favorable to the state, the evidence was that Donnie, believing that his first cousin, James "Rocky" Hawkins, was the "cause of all his problems," shot Rocky...
