198 N.J. Super. 553 (1985)

487 A.2d 1278

STATE OF NEW JERSEY, PLAINTIFF-APPELLANT, v. JOHN T. JONES, DEFENDANT-RESPONDENT.

Superior Court of New Jersey, Appellate Division.

Decided January 29, 1985.

Attorney(s) appearing for the Case

Joseph A. Fusco, Atlantic County Prosecutor, attorney for appellant (Steven M. Janosko, on the brief).

No brief was filed on behalf of respondent by the Public Defender.

Before Judges MICHELS, PETRELLA and BAIME.

The opinion of the court was delivered by BAIME, J.A.D.

This appeal presents difficult questions pertaining to the constitutional validity of N.J.S.A. 2C:39-7.1 That statute prohibits any person previously convicted of certain designated offenses from possessing a weapon. The term "weapon" is defined in N.J.S.A. 2C:39-1r as including "anything readily capable of lethal use or of inflicting serious bodily injury."
