ADAMS v. LUDWIG

No. 84-1314.

473 So.2d 277 (1985)

Paul R. ADAMS and Edith G. Adams, Appellants, v. Timothy A. LUDWIG and Mary J. Ludwig, Appellees.

District Court of Appeal of Florida, Fifth District.

August 1, 1985.

Attorney(s) appearing for the Case

Jay Adams, Tallahassee, for appellants.

J. Doyle Tumbleson, Glenn R. Padgett and Kurt Borglum of Kinsey, Pyle, Williams & Tumbleson, P.A., Daytona Beach, for appellees.

DAUKSCH, Judge.

This is an appeal from a circuit court judgment based upon a complaint seeking damages in the amount of $300.00. Appellees, who were the defendants, somehow convinced the county court judge to transfer the case to the circuit court because they maintain that their defense was based upon the provisions of a particular stipulation and final judgment involving these parties, which stipulation and judgment were in the circuit court in another case.
