HILL, Justice.

Defendants, Alexander Evarts and Judith Browne, appeal from a judgment entered against them on a claim by the plaintiff, Clarence Prevo. Plaintiff sought to recover for damage to an apartment owned by him which he leased, under an oral contract to Evarts, and which was occupied at the time of the damage by Browne. We affirm.
