Harold Warnert began this unlawful detainer proceeding against his tenant, MGM Properties, and against MGM Properties' subtenant, Richard Schmidt, alleging MGM Properties' failure to pay rent. The day before trial MGM Properties and Warnert entered into a stipulation of settlement that included MGM Properties' surrender of the premises to Warnert.
