On rehearing, the previous opinion is withdrawn and the following is substituted.

Defendant appeals from a conviction of unlawful possession of a controlled substance, marijuana, with intent to distribute contrary to NMSA 1978, Section 30-31-22 (Repl.Pamp. 1980).
