This action arose when thirteen plaintiffs, all homeowners in the Foxhall North Subdivision in Montgomery County, sued three defendants — Ward Development Co., Inc., the developer of the subdivision; Long and Foster Real Estate, Inc., Ward's real estate broker; and William Conrad Behrens, a selling agent with Long & Foster — for fraudulent and negligent misrepresentation.
