Presently before this Court is the defendant's motion to dismiss the complaint for lack of subject matter jurisdiction and for failure to state a claim upon which relief may be granted. The motion is granted because, contrary to plaintiff's contentions, the Civil Service Reform Act of 1978 ("CSRA") has not superseded Title VII of the Civil Rights Act of 1964.
