Defendant Charles Okafor was tried for murder in the second degree and related charges arising out of the shooting death of his wife Patience Okafor. Following the People's direct case and after defendant himself testified, the People offered as part of their rebuttal case certain former testimony given by the deceased at a prior Family Court hearing. The People had sought to introduce this testimony, in which the deceased related threats...
