In December 1979 petitioner Wayne Kinkade was convicted in New York of two counts of burglary in the first degree and one count of assault in the second degree. He was then sentenced to a maximum of 10 years and a minimum of 5 years, and incarcerated at the Ossining Correctional Facility.
