In a bench trial held March 16, 1977, the petitioner-appellant, Harry Ferguson, was convicted of possession of less than ten grams of heroin, a Class D felony. See IND. CODE § 35-24.1-4.1-6 (1976) (repealed 1977; presently encoded as amended at IND. CODE § 35-48-4-6 (Supp. 1983)).
