The defendant, Scott McLarty, appeals his conviction for the offense of driving under the influence of intoxicants. On the evening of August 16, 1983, the Chief of Police of Statham, Georgia, was sitting in his patrol car by the side of U. S. 29, which traverses Statham. The speed limit is 35 miles per hour.
