Woods, was found guilty in a bench trial of grand theft under the second count of the indictment, in which he was charged with obtaining $70,000 from Dorothy Berning by deception, in violation of R.C. 2913.02. He was also found guilty of the forgery and uttering of a $70,000 check payable to Dorothy Berning under the third and fourth counts, in violation of R.C. 2913.31.
