OPINION
BEVILACQUA, Chief Justice.
The defendant, James J. Hughes III, was indicted by a grand jury on November 5, 1982. The indictment charged him with three counts: (1) murder in violation of G.L. 1956 (1981 Reenactment) § 11-23-1, (2) robbery in violation of G.L. 1956 (1981 Reenactment) § 11-39-1, and (3) larceny over $500 in violation of G.L. 1956 (1981 Reenactment) §§ 11-41-1 and 11-41-5.
