FORET, Judge.

The defendant, David H. Huddleston, was charged by bill of information with two counts of distribution of marijuana, a violation of LSA-R.S. 40:966 A(1). On April 17, 1984, a twelve person jury found the defendant guilty as charged. The defendant was sentenced to serve three years in the Department of Corrections on each count, with the sentences to run concurrently. The defendant appeals, urging the following three assignments of error:
