Respondent Robert Gordon Miller was indicted for murder, housebreaking, and larceny. The case was tried before a jury as a capital murder case. At the conclusion of the State's case, respondent moved for a directed verdict which was denied. Respondent then rested without presenting evidence and renewed his motion for a directed verdict.
