Defendant Barbara Kelly was indicted for larceny of an automobile from dealer McCurry-Deck, Inc. At the close of the State's evidence, the trial judge dismissed the charge because the crime was not alleged to have occurred without the owner's consent. Defendant was subsequently indicted for obtaining property by false pretenses, tried by a jury, and convicted.
