Richard Baggett sued The National Bank and Trust Company to recover damages for the bank's alleged action in causing him to be arrested and detained as a suspected bank robber. The complaint was grounded on theories of both false imprisonment and negligence. The trial court granted the bank's motion for summary judgment with respect to the false imprisonment count but denied the motion with respect to the negligence count.
