Plaintiff Helen Clemas has brought this action under the Civil Damages Act, Minn. Stat. § 340.95 (1980), against Nino's Steak Roundup and Blacksmith Lounge which allegedly served her husband, Gerald Clemas, alcohol when he was obviously intoxicated.
