The sole issue presented by defendants' appeal is whether plaintiffs are entitled to prejudgment interest. We note at the outset that defendants assert and plaintiffs concede that plaintiff, Christopher David Harwood's action (80CVS7968) was pending litigation on 5 May 1981. When plaintiffs instituted their first actions on 13 August 1980, G.S. 24-5 did not give plaintiffs the right to prejudgment interest...
