On May 15, 1980, the defendant-appellant, Roosevelt Batiste, and a co-defendant, were indicted for the second-degree murder of Reginald Holmes. The defendant was tried before a twelve-person jury on February 17, 18 and 19, 1981, and found guilty of manslaughter. The trial judge sentenced Batiste to serve 10 years at hard labor on February 23, 1981, and the defendant appealed to the Louisiana Supreme Court.
