On May 15, 1980, the defendant-appellant, Roosevelt Batiste, and a co-defendant, were indicted for the second-degree murder of Reginald Holmes. The defendant was tried before a twelve-person jury on February 17, 18 and 19, 1981, and found guilty of manslaughter.
