This appeal is from a final judgment denying appellant's claim under a theory of subrogation. We reverse.

In March, 1982, appellant James Dolan sold his residence located in Broward County to appellee Glenn Borregard. Dolan received a purchase money second mortgage in the amount of $160,000.00.
