The defendant was convicted by a jury of assault on a child under sixteen with intent to commit a rape, G.L. c. 265, § 24B, on an indictment charging rape of a child under sixteen years of age (G.L.c. 265, § 23). The defendant appealed his conviction, and we allowed his application for direct appellate review.
