STATE v. DIXON

No. 14503-7-I.

42 Wn. App. 315 (1985)

711 P.2d 1046

THE STATE OF WASHINGTON, Respondent, v. REGINALD DERWIN DIXON, Appellant.

The Court of Appeals of Washington, Division One.

December 16, 1985.

Attorney(s) appearing for the Case

Paris K. Kallas of Washington Appellate Defender Association, for appellant.

Norm Maleng, Prosecuting Attorney, and Kathryn Goater, Deputy, for respondent.

WEBSTER, J.

Defendant Reginald Derwin Dixon appeals his conviction of being a felon in possession of a firearm, contending that the charge should have been dismissed under CrR 4.3(c) because he had already been tried for a related offense, and that a police officer's testimony as to statements by the defendant's wife should have been excluded. Because we conclude that the mandatory joinder rule was violated, we do not reach Dixon's second argument.
