PEOPLE v. STROH

111 A.D.2d 196 (1985)

The People of the State of New York, Respondent, v. John Stroh, Appellant

Appellate Division of the Supreme Court of the State of New York, Second Department.

May 6, 1985

Judgment affirmed.

The defense was predicated on the lack of intent to commit murder. Here, where the photographs of the deceased victim were offered to prove defendant's intent to commit murder and disprove the defense of justification, their admission into evidence was proper (see, People v Pobliner, 32 N.Y.2d 356, cert denied 416 U.S. 905).
