The plaintiff town brought this action for an injunction to restrain the defendants from serving beer at a restaurant they own in the town. Two other proceedings which shape the configuration of the case preceded this action, as more fully set forth below. The trial court denied the request for an injunction. The plaintiff appealed from that judgment. We find error.
