This action arises under the Federal Tort Claims Act, 28 USC §§ 1346 (b), 2671 et seq. The plaintiff's date of birth is March 20, 1920. He is a widower and has five children. He was member of the United States Navy from June 6, 1942 until October 26, 1962. Upon his discharge from the Service, he was an employee at the Portsmouth Navy Yard for approximately nine years.
