Idaho Power Company (Idaho Power) appeals from a decision by the Federal Energy Regulatory Commission (FERC) to exempt the Magic Water Company (Magic Water) from obtaining a license to construct a hydroelectric facility. Idaho Power argues that FERC abused its discretion in granting the exemption because it did not determine that there was a need for the proposed project. We have jurisdiction to review...
