Plaintiff instituted this action under the Federal Employer's Liability Act, 45 U.S.C. § 51, et seq., seeking damages for injuries allegedly resulting from a work-related accident. Trial was held and a special verdict returned by the jury, finding the negligence of both parties to be 50% and plaintiff's damages to be $10,000.00.
