LUM, Chief Justice.

Defendant-Appellant Romeo Uganiza appeals the denial of a pretrial motion to suppress his inculpatory statement made while in police custody and a conviction for Burglary in the First Degree in violation of HRS § 708-810(1)(c). As we conclude that the police violated the Defendant's asserted right to remain silent, we reverse the ruling of the trial court and the resulting conviction.
