CARDINE, Justice.

This is an appeal from a dismissal with prejudice of appellant's action for eviction as a sanction for a failure to attend a scheduled deposition. We reverse.

"I. The Discovery Sought By The Appellee-Defendants Was Unnecessary As There Was No Material Issue of Fact. "II. The Court Abused Its Discretion In Dismissing The Appellant's Lawsuit With Prejudice."
