This appeal stems from a Workers' Compensation Board (the Board) decision denying a petition for modification. The superior court reversed the Board and remanded the case with instructions to award Marx permanent total disability benefits. Marx's employer, Usibelli Coal Mine (Usibelli), now appeals on the ground that the Board's denial of the petition for modification was supported by substantial evidence. We reverse the...
