The Niagara County Department of Social Services brought these proceedings to terminate the rights of the parents in their three children and to free them for adoption on the ground of permanent neglect (Social Services Law § 384-b [4] [d]). Because the father had suffered several heart attacks, Family Court adjourned the fact-finding hearing from time to time for a total period of 14 months and finally granted the father's motion to dismiss...
