The controversy in this case centers around the "itinerant surgery" rule of the defendant American College of Surgeons ("ACS"). That rule defines itinerant surgery as follows:

The performance of surgical operations (except on patients whose chances of recovery would be prejudiced by removal to another hospital) under circumstances in which the responsibility for diagnosis or care of the patient...
