Miller Construction Company brought suit for breach of contract against Stresstek. Miller sought to recover the difference between the amount it paid a subcontractor for work done on a highway overpass and the amount bid for the same work by Stresstek. Miller alleged that the parties had an oral contract for the work, while Stresstek maintained that it was not bound because it had not signed a written contract...
