Appellant, Gregory Lynn Smith, was arrested for driving under the influence of alcohol (D.U.I.) in violation of § 32-5A-191, Code of Alabama 1975. The Montgomery County District Court found appellant guilty as charged on September 13, 1983. Appeal was made to Montgomery County Circuit Court, where appellant demanded a trial by jury.
