TYSON, Judge.

Bernard Talley was charged by indictment with escaping from the custody of S.A. Eiland, a lawful officer of the Montgomery Police Department, contrary to § 13A-10-33, Code of Alabama 1975 as amended.

The jury found the appellant "guilty as charged in the indictment", and following a filing of a motion to invoke the Habitual Felony Offender Act, the appellant was found to have two prior felonies and was sentenced in this cause to 10 years...
