This is a direct appeal from a conviction for neglect of a dependent, a class B felony, Ind. Code § 35-46-1-4 (Burns 1985 Repl.) and from a habitual offender determination. This case was tried before a jury. Defendant-Appellant was sentenced to a prison term of forty years.
