Lipin Enterprises, Inc. (Lipin) brought this action against a number of defendants under the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. §§ 1961-68 (1982). The case is before the court on defendants' motion to dismiss.1
