On May 13, 1983, James William Nessmith was convicted of perjury in an official proceeding in violation of section 837.02, Florida Statutes.1 He presents four points on appeal, three of which we find unmeritorious. His fourth argument, that the state failed to prove the perjured statements were made in an official proceeding, is welltaken.
