This is an ejectment action in which a suggestion of adverse possession was interposed as a counterclaim.

This case was first tried before a jury in the Circuit Court of Etowah County in August of 1982. In that action, the trial court granted a directed verdict on the issue of ownership in favor of the plaintiff, Harvey Croft, and the jury awarded damages.
