In late 1982, appellants Benjamin Ruggiero and John Cerasani were prosecuted in the United States District Court for the Southern District of New York for substantive and conspiracy violations of the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. §§ 1962(c) and (d). Ruggiero was convicted of conspiring to violate RICO, but was acquitted of the substantive RICO count. He was sentenced to fifteen years in prison...
