Defendant, Gary Thomas LaGrange, pleaded guilty to distribution of marijuana, a violation of LSA-R.S. 40:966(A)(1). The trial judge sentenced defendant to serve six years at hard labor and a $7500 fine, and in default of payment one additional year at hard labor. Defendant appeals claiming that the trial judge failed to apply the sentencing guidelines of LSA-C.Cr.P. Art. 894.1 and that the sentence is excessive. We vacate defendant's sentence, finding...
