This cause came on to be heard upon an appeal from the Court of Common Pleas of Hamilton County.

On May 19, 1978, a fire of undetermined origin occurred at River Downs Race Track in Hamilton County, Ohio, causing damage to the stable area and injury and death to horses kept therein.
