On February 16, 1984, Mark E. O'Bar, Sr. ("plaintiff"), pro se, filed a small claim petition, § 482.340.1, Laws 1982, p. 660, against Wanda Nickels ("defendant") asserting he had a claim against her in the amount of $1,000. The petition alleged that the claim arose on or about February 4, 1984, as a result of the following events:

"No heat in my Apt. that I rent for 300.00 a month with utilitys...
