In this tort action Plaintiff seeks damages for personal injuries suffered while working on a utility pole belonging to Defendant, United Inter-Mountain Telephone Company. Plaintiff's immediate employer, Wright and Lopez Construction Company, was performing work for Defendant pursuant to a contract.
