Donna Shondel and Mark McKechnie, former employees of Hammond, Indiana, sued the mayor of Hammond (McDermott), other city officials, and city agencies, under section 1 of the Civil Rights Act of 1871 (now 42 U.S.C. § 1983), charging that the defendants had violated the plaintiffs' rights under the First Amendment, as held applicable to state action by virtue of the Fourteenth Amendment.
