LAVENDER, Justice:

Appellee, Marvin D. Mann, initiated this action against appellant State Farm Mutual Automobile Insurance Company seeking recovery of losses sustained as a result of the "theft" of an insured automobile. Appellant admitted the existence of a contract of insurance as to the automobile, but denied coverage of the loss under the provisions of the contract.
