The state appeals from a district court judgment declaring unconstitutional an obscenity statute which prohibits the intentional public exposure of genitals. The district court concluded that the penalty provisions of the statute deny equal protection of laws and authorize excessive punishment by their failure to distinguish between non-commercial exposures and obscenity for commercial gain.
